BERUAS: A man with disabilities was sentenced to three weeks in jail by the Pantai Remis magistrate's court for trespassing at the home of Pengkalan Baharu assemblyman Azman Noh.
Magistrate Nurul Izalina Rajaai ordered Mohd Khairol Anuar Nordin, 36, to serve his sentence from the date of his arrest on Oct 12.
According to the charge sheet, the man, who has a disability in his right leg, was accused of entering Azman's residence in Kampung Bakar Bata, Ayer Tawar, with the intent to commit an unlawful act without the owner's consent at 10pm on Oct 12.
He was charged under Section 447 of the Penal Code, which carries a maximum penalty of six months in prison, a fine of up to RM3,000, or both.
The prosecution was led by deputy public prosecutor Mohd Hairol Jemain, while the accused was represented by lawyer A. Sive Ganesh from the National Legal Aid Foundation.
In his plea for leniency, the accused requested a minimum sentence, explaining that he works on his family's palm oil plantation, earning RM1,000 a month, and has to support his parents.
When Nurul Izalina asked why he trespassed, Mohd Khairol Anuar replied, "I don't remember; it felt like I was under a spell."
When asked who cast the spell, he said he did not know.
Nurul Izalina then cautioned him not to repeat his actions.
"Whether you were under a spell or have a disability, that is not an excuse for committing a crime and trespassing. If you were to enter a house with a dog and got bitten, it would be your problem," she warned.
