KUALA LUMPUR: An unemployed man was today sentenced to a year's jail by the Ampang magistrate's court after pleading guilty to trespassing and vandalising his ex-girlfriend's family home.
Magistrate Amalina Basirah Md Top handed down the jail term on Mohd Imran Othman, 32, and ordered him to serve the sentence from his arrest on Sept 25.
He was charged with trespassing into his ex-girlfriend's father's house, committing mischief by smashing a glass door and door knob as well as threatening the ex-girlfriend aged 24.
He committed the offences at 1.30pm at a house in Taman Melawati on Sept 18.
The charges were framed under Section 448 of the Penal Code which carries a maximum three-year jail term or a fine up to RM5,000; Section 427 of the Penal Code which provides a jail term not less than one year and not more than five years or a fine or both; as well as Section 14 of the Minor Offences Act which provides a maximum RM100 fine.
The facts of the case read that the victim had heard a rock thrown at her room window and upon checking, she saw her ex-boyfriend damaging a glass door with a dumbbell at the back of the house while screaming out her name.
While she hid in the toilet of her room to call 999, he had kicked at her room door and used the dumbbell to unsuccessfully break it down to enter.
He then climbed onto the balcony and broke her window while saying,"You get out now. I want to hit you. If not, I will try to enter your room."
Deputy public prosecutor Norhidayah Abdullah Sani had asked for a heavy penalty to be imposed on the accused.
"The victim is traumatised. The court should take into consideration the huge losses suffered by the victim due to his actions and public interest," she said.
In mitigation, National Legal Aid Foundation lawyer Nadia Irwanita Mohamed Rosli asked for a light sentence as the guilty plea had saved the court's time and cost.
"The accused is remorseful and the incident stemmed from a misunderstanding with his ex-girlfriend," she said.
