BATU PAHAT: A 31-year-old peanut vendor pleaded not guilty to assaulting his wife, whom he accused of infidelity at the Yong Peng magistrate's court here today.
The incident allegedly took place on Nov 2, with the accused, Mohamad Amizan Shafiq Md Hisham, allegedly slapping his 36-year-old wife thrice in a confrontation in Jalan Bintang at 6pm.
The defendant appeared before magistrate Suhaila Shafi'uddin, where he denied the charges that were read out by the court interpreter.
In addition to the assault charge, Amizan also pleaded not guilty to a second charge of damaging a car.
According to the charge, he was accused of kicking the car occupied by his wife and her male acquaintance, causing dents on the vehicle at the same time and location.
According to court documents, in the first charge, Amizan faced a year in prison, a RM2,000 fine or both upon conviction, with the possibility of a double the maximum penalty for repeated offences.
The second charge, which was for causing criminal mischief, carried a maximum sentence of three months in prison, a fine, or both upon conviction.
According to the police report, Amizan's wife had gone out for a meal with her male friend, who worked as a pizza baker.
During the journey, Amizan allegedly pursued the car on his motorcycle and signalled for it to pull over.
Upon confronting his wife, he allegedly slapped her three times, which resulted in visible injuries.
Following the alleged assault, the wife lodged a report at the Batu Pahat district police headquarters on the same day.
The case was prosecuted by Inspector Muhammad Faidz Md Khalid, while Amizan was represented by Zuliyati Awang.
The court set Nov 5 as the date for document submission and granted Amizan bail at RM3,000 with one guarantor.
Additionally, the court imposed a condition prohibiting him from contacting or harassing the victim until the case is resolved.
