KLANG: A burger seller was sentenced to six months in jail and fined RM1,000 by the magistrate's court for assaulting his ex-girlfriend with a baseball bat, smashing her car's front windscreen and swinging a parang at her in August.
Magistrate Siti Zubaidah Mahat sentenced Akmalrulnizar Hafif Kamarulhisham, 23, after he pleaded guilty to three charges of voluntarily causing hurt, committing mischief, and criminal intimidation.
She ordered him to serve the jail sentence from his arrest on Aug 11.
She ruled he must serve four months in jail if he fails to pay the fine.
On the first count, he was charged with voluntarily causing hurt to Nur Hiedayu Mudzakir, 23, with a baseball bat, an act which could have caused her death.
The charge under Section 324 of the Penal Code carries a maximum 10-year jail term, a fine or whipping or both upon conviction.
On the second count, he was charged with committing mischief by smashing her car's front windscreen.
The offence under Section 427 of the Penal Code provides a maximum of two years jail term, a fine or both upon conviction.
On the third count, he was charged with criminally intimidating her by swinging a parang.
The charge under Section 506 of the Penal Code carries a two-year jail term or both.
All the offences were committed at 6am in Kampung Teluk Gong on Aug 10.
In mitigation, National Legal Aid Foundation lawyer Muhamad Saifullah Muhamad Azmi said Akmalrulnizar was remorseful and asked for a short jail term.
"He wants to tell the court that there was a misunderstanding between him and the victim and he had accidentally lost grip of the baseball bat and it hit her," he said.
Deputy public prosecutor Nuruljannah Aimi asked the court to hand down a heavy punishment on Akmalrulnizar as a deterrent and for public safety.
"The victim suffered losses of RM500 after he smashed her car's front windscreen. He had also hurt her knee with the baseball bat and had swung the parang at her," she said.
