SEREMBAN: The Syariah Lower Court here approved a 'fasakh' (divorce) application from Jahidah Nordin, 44, against her husband, Rosmaini Abd Raof, 40.
The happiest person to receive the news was Jahidah's sister, Fauziah, 41, who represented the woman now bedridden due to the injuries sustained in an incident in May 2021.
Fauziah said she applied for the 'fasakh' on Feb 1 and was grateful that the process was smooth and she did not have to wait for long.
"I am grateful because we have been waiting for a decision on the marriage status of my sister. I did not expect to get a decision today. It has lessened my burden.
"I will discuss with the lawyer about the next move because it has to be done one by one since I have to care for my sister and her children," said Fauziah when met outside the court.
She said she was relieved and could now focus on the criminal case involving Rosmaini, which is still ongoing in court.
"I am happy and could not wait to inform my family of the decision. For the next process (child custody and alimony), I will discuss with the lawyer."
Earlier in court, counsel Mohd Amirul Adam Ahmad from the Negri Sembilan Legal Aid Department, who was representing Fauziah, submitted a written statement to judge Hamizan Mohd Nor.
The seven-page statement comprised of 31 questions and answers before Hamizan asked further questions to Fauziah during the proceeding.
The judge also asked Fauziah about 'nafkah' (alimony) for her sister, to which Fauziah said the husband had never visited or contacted Jahidah and she never received any alimony.
Mohd Amirul said the judge made the decision after the court was satisfied with the written statement by the 'ad litem' guardian and based on the document that was submitted.
"We applied for 'fasakh' in February. The application was supposed to be made by Jahidah but due to her condition, we had to make an 'ad litem' guardianship application at the Syariah High Court and the asset management application at the Malaya High Court in January.
"The court was satisfied with the decisions of both courts and today decided that the marriage of Jahidah and Rosmaini is dissolved from today," said Mohd Amirul.
It was reported in May 2021 that a pregnant woman was seriously injured after she was allegedly assaulted by her husband.
The woman, a civil servant at a government department, was transferred to the Tuanku Ja'afar Hospital here after receiving initial treatment at the intensive care unit of the Sultanah Aminah Hospital in Johor Baru.
The woman suffered bleeding to the head as well as fractures to the jaw, spine and ribs.
