KUALA LUMPUR: Puteri Sarah Liyana has filed an application for "hadanah" (permanent full custody) over her two children, Syaikhul Islam and Sumayyah, at Syariah High Court, here, this morning.
The actress, whose full name is Puteri Sarah Liyana Megat Kamaruddin, confirmed that she filed the application, and named her husband Syamsul Yusoff as the defendant.
The 38-year-old actress arrived at the court complex around 10.59am, accompanied by lawyer Puteri Umi Kartini Abdul Latif, who confirmed that the application was filed under Section 81 of the Islamic Family Laws Act Federal Territories) 1984.
"The section permits either parent in a marriage who are going through a divorce process or are already divorced to file for hadanah as it is within their rights.
"We have yet to hand over a copy of the application to the other party as we had just filed the application this morning.
"After that, we'll wait for the court to fix a date for mediation," she said when met by the press after filing the application.
Asked why she had decided to file for hadanah, Puteri Sarah giggled, then calmly said: "Sebab semuanya tiba tiba (since everything happened so suddenly).
"What happened yesterday was also sudden. We're all going by 'suddenly' these days," she said.
Puteri Sarah and Syamsul were married on March 8, 2014 and have two children Svaikhul Islam, 6, and Sumayyah, 4.
The actress filed for divorce from her husband on Jan 16, after he took on a second wife.
Yesterday, Syamsul filed an application for "nusyuz" against Puteri Sarah at the Gombak Timur Lower Syariah Court, Selangor.
Syarie lawyer Azmi Mohd Rais, who represents Syamsul, yesterday was quoted as saying that the move was not an act of revenge but an attempt to save their marriage.
He had said Syamsul had filed an application for nusyuz due to several reasons that includes Puteri Sarah having left their home since October 2020 and has slandered Syamsul by alleging that he hit her and does not provide financial support.
