Bandar Tun Razak voters withdraw judicial review bid on EC redelineation exercise

KUALA LUMPUR: Three Bandar Tun Razak voters have withdrawn their leave application for a judicial review of the Election Commission (EC)’s proposed redelineation at the parliamentary constituency.

They had through their lawyer Syahredzan Johan made the withdrawal after receiving a letter from the EC dated July 27 which stated that they will carry out a local inquiry for the second time.

After hearing submissions from both parties, High Court judge Datuk Wira Kamaludin Md Said struck out the application in chambers today.

The voters are Mohammad Saiful Mansur, 44, Mohd Khairuddin Asmuin, 40, and Norma Hashim, 58, who were representing 99 registered voters of the Bandar Tun Razak parliamentary constituency.

In a letter by the EC, it stated that it will carry out a second local inquiry for the Bandar Tun Razak parliamentary constituency on Aug 8 at its office in Putrajaya.

Syahredzan said since the EC has agreed to carry out the inquiry, the judicial review now has no basis and therefore his clients have decided to withdraw the suit.

In their leave application for judicial review, they had sought a certiori order to quash the EC's decision not to carry out a local inquiry.

Among others, they also sought a mandamus order to compel the EC to carry out local inquiry at Bandar Tun Razak.
