Family of teen killed in crash wants case to be investigated for murder

IPOH: Muhammad Zaharif Affendi Muhd Zamrie's family hope the crash which led to the teenager's death would be investigated under Section 302 of the Penal Code for murder.

The teenager's father, Muhd Zamrie Zainal Abidin, 55 said no motorist would purposely crash into another human being without intention.

He said this today as the remand order on the police officer who drove the car which rammed into a Zaharif, 17, ends tomorrow (Nov 18).

"I want the truth. If he purposely hit my son, it means that he has the intention to kill him.

"But the man claimed that it was just an accident. What kind of accident is that when my son hurt so bad? He is dead," Zamrie said when met at his home in Taman Chepor Sentosa here today.

Zaharif's sister, Nur Zawani, 28 who was at the scene of the accident said the perpetrator did not shown any feelings when seeing her brother's condition.

"I want this case to be investigated under Section 302 (of the Penal Code). I was at the scene. I saw (the police officer's) face.

"We can read people's body language and I saw his face and his reaction. He was not panicking at all. He was not scared. He just looked like a bystander who happened to be there just to see the accident.

"He didn't look nervous. If a person hits someone unintentionally, he would panic and be scared. But he looked calm and satisfied with what he had done."

When asked about the condition of her father, Nur Zawani, who works as a nurse said her father had had bariatric surgery in August last year.

"After that surgery, my father can't be under pressure or overly tired. When he's in both situations, he'll pass out," she said.

Zaharif's mother, Mimi Julia Ismail, 50 said her husband has not eaten anything since their son died.

"He only drinks water but he can't eat anything. He told me that every time he tries to eat, he'll remember his son."

Datuk Wan Azmir Wan Majid, who is a lawyer representing the family, said based on the developments, his team may pursue civil action against the perpetrator and probably the government.

"We are asking for compensation related to a civil action following the teenager's death. This will ensure appropriate compensation is given to the family of the deceased."

"We are also looking at negligence."

"Whether is the police officer who is at fault, or the government or the police force, it is too soon to say until we established the liability of this case."

The case is g investigated under Section 41(1) of the Road Transport Act 1987 for causing death by reckless or dangerous driving.

However, district police chief Assistant Superintendent Yahaya Hassan had said police will carried out he probe from various angles, including that of murder if there was evidence.

Zaharif died following the 12.30pm incident on Friday. It is understood that before the incident, there was an altercation involving the police officer in the car and the victim, who was making noise on his motorcycle.

The police officer, 44, chased the victim for almost 1km before hitting him from behind. Due to the impact, the victim fell and was dragged almost five metres.

It is learnt that the driver of the Perodua Ativa involved turned back to the location to see the condition of the victim, but immediately drove away when he realised the heavy presence of the public.

The police officer was subsequently detained.
